Terms of Service

These Terms of Service ("Terms") govern your access to and use of the VolkPay platform, including our website, mobile applications, APIs, and virtual card services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms in full.

You must be at least 18 years of age and capable of forming a legally binding contract to use VolkPay. The Service is not available in jurisdictions where it is prohibited by applicable law. By registering, you confirm that you are not located in, or a resident of, any jurisdiction subject to comprehensive international sanctions.

You must provide accurate, current, and complete information during registration and keep it updated. You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activities that occur under your account.
• Notifying VolkPay immediately of any unauthorised access or security breach.
• Ensuring no other person uses your account without authorisation.

VolkPay is required by law to verify the identity of all users prior to card issuance. You agree to submit valid government-issued identification and any additional documentation we may request. Failure to complete verification will result in restricted account functionality. We may suspend accounts where verification cannot be completed satisfactorily.

Virtual Visa® cards issued through VolkPay are subject to the terms and conditions of our licensed card-issuing partners. Cards are funded by your VolkPay account balance and are intended for lawful purchases only.

VolkPay reserves the right to decline, reverse, or suspend transactions that appear fraudulent, in violation of applicable law, or contrary to card network rules. We are not liable for any merchant refusal to accept payment.

You agree not to use the Service for:

• Any unlawful purpose, including money laundering, terrorist financing, or fraud.
• Purchasing illegal goods or services of any kind.
• Circumventing sanctions, trade restrictions, or card network operating rules.
• Attempting to reverse-engineer, scrape, or disrupt any part of the platform.
• Impersonating another person, entity, or regulatory body.
• Any activity that would constitute a violation of applicable financial crime legislation.

Applicable fees are disclosed in your account dashboard and updated periodically with advance notice. Cryptocurrency-to-fiat conversions are executed at real-time market rates at the time of transaction. VolkPay does not guarantee any specific exchange rate and is not responsible for market fluctuations.

To the fullest extent permitted by applicable law, VolkPay shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, arising from your use of the Service. Our aggregate liability to you shall not exceed the total fees paid by you to VolkPay in the twelve (12) months preceding the claim.

We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms, applicable law, or for risk-management purposes. You may close your account at any time by contacting support. Outstanding balances will be returned subject to applicable verification and regulatory requirements.

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which VolkPay Inc. is incorporated, without regard to its conflict-of-law provisions. Any disputes shall be resolved through binding arbitration under applicable arbitration rules, except where such provisions are prohibited by local law.

We may modify these Terms at any time. Continued use of the Service following notice of changes constitutes acceptance of the revised Terms. Material changes will be communicated at least 14 days in advance by email or platform notification.
